Can a claim be filed against city of Worthington, OH for sewer backup into home-from main line,not hmwnr line?

Raw sewage backed up into basement ruining everything. All kinds of "floating goodies". City says it is not their responsibility, even though the cause was a root blockage 9 houses away.

  2. Who would you file a claim with? The only thing you could do would be to sue the City of Worthington, Ohio. The cost of a civil suit, through trial, would be at the very least, $20,000. Good luck with that.
  3. You need to file a claim on your homeowner's insurance. Nearly all insurance policies will cover this. If your insurance company feels the city is responsible, they will send the claim to Subrogation, and THEY will sue, saving you the trouble.
  4. It depends on many things...was the line on public access or public access/easement or priviate property? Did you contact the city about the situation before it happened so they knew of a possible back up? Did you contact the city once it had backed up to fix the problem or did you take care of it yourself? A note: If you do end up having a case, it will not cost $20,000 to pay for it. It will probably be 1/3 of what you collect.
