I did have a full home inspection, no septic was mentioned!?
We had a home inspection and it stated in there it was public sewer because that is what was on the listing sheet. We were told today at the realtors office that when the seller purchased the home they had aeration listed on their sheet. Why didn't they list it again? I think they knew it was a bad system. I have documentation of everything and we were absolutely lied to. Who do we go after. The sanitation co. told us today, that we have the most expensive sytem made and it is $500 every two years to maintance. I had stated $3,000 at minimum and that is just what he could see. We didn't even get our $500 back today for that out of pocket expense. Yes, there should have been a septic inspection, had it been known. The home inspector we used does not cover septic systems. This whole thing is a mess and I don't know where to start. Thanks for all your responses before!

- Your first problem is the home inspector - you can definitely go after him, then the owner and the realtor - of course all these things cost money - for example i had an owner and realtor lie about the size of a property by 500 sq ft which comes to a lot of money - i had proof i went to court and i won - i spent 75,000 on legal fees to recoup a 50k deposit - it felt good but thats all that happend - hope you do better
- The sanitation company should be able to show proof that they did work on that property for the prior owner. At least under a suboena they could. The inspector, maybe there was a way he could've known, maybe not. I have no idea if that's somehow visible, but ultimately he can't be responsible for knowing what happens once the pipes go away from the house. But the seller, and the listing agent, absolutely should have known. Unless somehow this "aeration" is some cute euphemism for septic, you should have cause to sue. Don't wait, the longer you do the harder it will get.
- Sounds like a mess. First check the Seller's Disclosure Statement and see what the owners said about the system. You must also consider the listing Broker may too have been misinformed by the Seller? The listing agent has no obligation to investigate the Sellers statements unless they feel something is questionable. If the Seller hid material facts then I would tell you to go after the Seller. If the inspector stated up front that he does not inspect/cover sewer systems then that's that. But if that was to be part of the report that's another thing. Before filing suit I'd try to work something out with the Seller thru your Agent. Otherwise the attorneys ALWAYS win! Check the disclosure statment and go from there....Good Luck
- call a lawyer and seek the home inspector, he and the realestate people totally should have known this. they are at fault. buyer beware!
