What can I do about a landlord who wont pay me back for a repair that was not my fault?
I was renting a house and I had a sewer back up in my basement. I called my landlord to have a plumber come out and fix it. The landlord said it was my place to call the plumber and pay for it. HE blamed my two year old daughter for stopping it up. Any way, the plumber came out and fixed the line. He found a mass of tree roots in the sewer line. The roots had stopped the lines up. I told the landlord and that is was not our fault it was the tree roots so he has to repay me. Its been two months and no repay. How long do I have befor I can take legal help? Who do I need to contact about this? Thanks

- File in small claims court, but keep paying your rent until you get your judgement !!!
- As the landlord he IS responsible for this. Send him a copy of the bill and if he does not pay it than take him to small claims court, but be expecting him to kick you out once your lease expires.
- Well it depends on where you are, here in australia we can call the rta which is the rental tenancy agreement, by law the owner has to pay for anything that is necessary, we had a blocked pipe so we called the real estate who got onto a plumber. We still ahve alot that needs to be done like we have stairs at the front and back of the house and both have extremely dangerous railings and yet the guy that owns our house won't do anything. Theres a form called a form 11 and if we fill out one of those and hand it in it looks bad on him. I think it's just like he's not doing anything, the guy that owns our house is a complete tight ass so of course we're going to sue him if anyone falls down our stairs (we have every right too). just look up the state laws on your computer for renting. or go to your real estate - by law here he would have to pay for the plumber but it may be different in your state
